Werckpost Beheer B.V. is located in Urk and registered in the Trade Register of the Chamber of Commerce under number 64650677. Regarding the protection of your privacy, the following policy applies: Werckpost guarantees, as far as possible, the protection of the privacy of all visitors to the site. This means that we also require our partners to make maximum efforts to safeguard personal data. Below you will find the personal data we process, what we do with this data, the legal framework under which this happens, and what you can do if you have any questions.

Processing of Personal Data

In the context of our services, Werckpost processes personal data. Below is an overview of the personal data that we may process, depending on the purpose for which the data was collected:

Employees/Temporary Workers

  • Other personal data actively provided by you, such as through registration, correspondence, and phone calls

Candidates

  • Personal details (name, address, etc.)

  • Phone number

  • Email address

  • Gender

  • Marital status

  • Education/work experience/skills/certificates (if relevant)

  • Holding a driver's license (if relevant for a position)

  • Other personal data actively provided by you, such as through registration, correspondence, and phone calls

Special and/or Sensitive Personal Data We Process
Werckpost does not process any special and/or sensitive personal data, unless you are employed with us. Employees refer to our privacy policy.

Why We Need Data

Werckpost processes your personal data for the following purposes:

  • Entering into an employment relationship and the relevant administration (including the pre-contractual phase and job mediation)

  • Maintaining and executing the employment relationship and managing payroll and personnel administration

  • Entering into and executing the agreement between Werckpost and our clients

  • Quality and management purposes, such as internal controls, audits, accountants' checks, and certifications

  • Evaluating the suitability and availability for job mediation

  • Fulfilling our reintegration obligations

  • Applying for subsidies, tax reductions, etc. (and evaluating whether the person is eligible)

  • Fulfilling legal obligations that rest on Werckpost

  • Fulfilling a court order or judgment

  • Providing information about our services and answering your inquiries

We use personal data only for the purpose for which it was provided and only to the extent necessary. Personal data will only be processed if one of the following conditions (grounds) is met:

  • It is necessary for the performance of an agreement in which you are involved, including the pre-contractual phase

  • It is necessary to comply with a legal obligation that rests on Werckpost

  • You have given consent (we are very cautious with this ground and it is rarely used)

  • It is necessary for the legitimate interests of Werckpost or a third party, unless the interests or fundamental rights and freedoms of the data subject outweigh the interests of Werckpost and/or the third party.

How Long We Retain Data

Werckpost will retain your personal data for as long as necessary to achieve the purposes mentioned above. After the (legal) retention period, your personal data will be destroyed.

If you are registered as a candidate or temporary worker with us, you consent to the processing of your data. This data will be retained for a maximum of 1 year, unless an employment contract is concluded.

If an employment contract (or other type of relationship) is established and ends, Werckpost will not retain personal data for longer than two years, unless there is a legal obligation to keep the data longer. A longer (legal) retention period applies to Werckpost (at least) in the following situations:
a. For all personal data in the payroll administration, Werckpost will retain it for 7 years. This period starts at the end of the fiscal year in which the administration is considered "current," not necessarily from the end of the employment relationship.
b. The data mentioned under points 1 to 111 will be retained by Werckpost for up to 5 years after the end of the calendar year in which the employment relationship ended:
i. The tax forms you completed (or the document where you indicated whether Werckpost should apply the tax credit)
ii. Copy of identity document
iii. Statements and decisions received by Werckpost from you

If a reintegration file is created during the employment period (for long-term illness) and this file is closed during the employment relationship, Werckpost will generally not retain this file for longer than two years (after completion of reintegration). If the reintegration file contains permanent agreements, such as adjustments in the use of aids or task content, it is necessary to retain these agreements longer. These agreements can be incorporated into the personnel file.

Administrative data on sick leave (such as data required for salary continuation obligations, the date of sickness notification, the duration of the illness, and the recovery date) will generally be retained for up to 5 years after the employment relationship ends. The data may be retained longer if there is a labor dispute or a dispute regarding the granting of disability insurance.

The retention period is otherwise for the duration of the (contract) agreement and for as long as you have not informed us that we are not allowed to process your personal data any longer.

Sharing with Others

Werckpost does not sell your data to third parties and will only disclose it when necessary for the execution of our agreement with you or to comply with a legal obligation. With companies that process your data on our behalf, we conclude a data processing agreement to ensure the same level of security and confidentiality of your data. Werckpost remains responsible for these processing activities.

Access, Correction, or Deletion of Data

Under the applicable laws and regulations – and according to the conditions therein – you have the following rights:

  • To request access to your personal data

  • To obtain rectification of incorrect personal data

  • To complete incomplete information

  • In certain cases, to have your personal data deleted

  • In certain cases, to restrict the processing of your personal data

  • In certain cases, to object to the processing of your personal data

  • To be promptly informed by Werckpost if a personal data breach occurs that likely results in a high risk to your rights and freedoms, unless Werckpost is not obligated to do so under applicable law.

You can send a request for access, correction, deletion, etc., to: info@werckpost.nl. To ensure that the request is made by you, we ask that you include a copy of your identification with the request. We ask that you black out your photo and Social Security Number (BSN) in this copy to protect your privacy. Werckpost will respond to your request as soon as possible, but within four weeks. In certain cases, we may have the right to refuse your request. In such cases, we will explain the refusal.

Security

Werckpost takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized changes.
